DECLARATION OF BOATING ACTIVITY EXEMPTION
I, Terry Clapham, Manager Water Supply East, Southern Rural Water (the Waterway Manager for Lake Glenmaggie), declare under section 203(3) of the Marine Safety Act 2010 (Vic) that the Glenmaggie and District Boat Club – Club Day racing event on 29 October 2016 and 30 October 2016 is exempt from:
- The requirements to operate a vessel at a speed not exceeding 5 knots within 50 metres of another vessel, as detailed in Clauses 2(c) of the Notice under section 15(2) of the Marine Act 1988 (Vic);
- The requirements of Regulation 96(5) and 97(1) of the Marine Safety Regulations 2012 (Vic) in respect to the requirements to carry a bailer, bucket with lanyard, torch, fire extinguisher, and paddles (competitors vessels only).
- The requirements of Regulations 96(6) and 100(3) of the Marine Safety Regulations 2012, in respect to the requirement to carry and wear a PFD. This exemption only applies to competing vessels with a reinforced cockpit, provided occupants wear a PFD as per the APBA rules.
- The requirements of Regulation 44(2)(b) of the Marine Safety Regulations 2012, in respect to the requirements for holders of Restricted Marine Licences to operate a vessel at a speed not exceeding 10 knots. This only applies to competitors in Formula Future J3 Class, provided they do not exceed 40 knots.The exemptions apply to competitors participating in Glenmaggie and District Boat Club Event between the hours of 7.00 am to 5.30 pm on 29 October 2016 and 7:00 am to 5.00 pm on 30 October 2016, at Lake Glenmaggie within the exclusion zone adjacent to the Glenmaggie and District Boat Club as marked by buoys, provided the stated safety controls and undertakings detailed in the Event Application, APBA Racing Procedures, APBA Rule Book and associated documentation are adhered to.Terry Clapham
